The Photos for Mac application is not installed from the AppStore, it is installed as part of OS X automatically, just like Mail or Contacts.
You cannot install it separately.
Look into your Applications folder. Photos for Mac should be right there.
Or are you trying to update iPhoto to version 9.6.1? The iPhoto update will give you that error message.
Then see Barney's User Tip:
Can't Update iPhoto because it is not available in the App Store.
