Turn off iCloud Photo Library and delete the photo off your phone, then turn the Photo Library back on if you want...or not.

What is preventing you from deleting the Photo on your device? If you have iCloud Photo Library turned on on both the Mac and the phone, then your photos "live" in iCloud, and anything you do on the Mac, the Phone, or in iCloud.com is reflected on all of the other places.

Are you certain that you have iCloud Photo Library turned on on the Phone as well as the Mac?

    Cheers,

Low resolution photos are stored on the device that took the picture. Higher resolution photos are stored in iCloud. If you delete it from the device that took the picture, it deletes it from iCloud and all other devices. If you delete it from iCloud it will stay on the device.

No, not correct. Any photo that you delete from any of the sources I indicated that have iCloud Photo Library turned on, and are signed on to the same iCloud account will delete the photo from everywhere: Mac, iDevice, iCloud.com. That is the whole purpose of iCloud photo library. To keep all devices and computers sync'd to iCloud with the same photos all the time.

You can turn off iCloud photo library and delete what you want. And if you can't have photos in iCloud that have been deleted off devices, then why do i have photos in my iCloud library from a 5s I wiped clean and sold?

The third sentence does not make sense and contradicts the second one. If you delete a photo from either place it will delete it everywhere if iCloud Photo Library is on. So, whether you delete it from the device that took the picture or delete it from iCloud, it will be deleted everywhere. And if you are optimizing photos on your device, then when you turn off iCloud Photo Library, if you have not downloaded all of your originals, then only those photos that are originals will remain on the device - the optimized photos will go away. Here's how Apple tells you to turn off iCloud Photo library safely on a device:

How do I turn off iCloud Photo Library on just one device?

You can turn off iCloud Photo Library on a single device when you follow these steps:

    • On your iPhone, iPad, or iPod touch, go to Settings > iCloud > Photos and turn off iCloud Photo Library.
    • On your Mac, go to System Preferences > iCloud > Options next to Photos, then deselect iCloud Photo Library.
    • On your Apple TV (4th generation), go to Settings > Accounts > iCloud and under Photos press Select to turn off iCloud Photo Library.

If you have Optimize Storage turned on, you might not have all of your original photos and videos on your device. To download the original photos and videos on your iOS device, go to Settings > iCloud > Photos and select Download and Keep Originals. On your Mac, open Photos, choose Photos > Preferences, then select Download Originals to this Mac. Then you can turn iCloud Photo Library off. You can also select the photos and videos that you want to download from iCloud.com.

If you "wiped it clean" by erasing all contents and settings, or restore via iTunes, that does not delete any iCloud content.

To delete iCloud content, you would manually remove content from the device before you wiped it clean. That would trigger deletions on iCloud.
