the sim had swapped over so no service on it now

Congrats on the new phone! Once you have everything moved over, you can erase the old phone, or restore it using iTunes, your call.
If your old phone is having trouble connecting to the AppleID Server, it has little to do with the new phone, or the fact that you're signed in. What you'll need to check is the data connection on the old phone. You likely don't have cellular service, and will need to make sure you are connected to WIFI. If it still cannot connect, you could troubleshoot further but it's not worth it.
Turn the old phone off, go to iCloud.com and sign in with the AppleID. Go to 'Find my iPhone' the 'All Devices' > Click on the old phone - it should show 'offline' and then you want to 'Remove from Account'. Then follow the steps in this article If you can't update or restore your iPhone, iPad, or iPod touch - Apple Support to perform a recovery mode 'restore' with iTunes. Once you have the white 'Hello!' screen on the phone, you can power it off.
