you can also verify the issue is with the headset by trying to connect them to a computer or something else with a 3.5mm minijack connector it's all std apart from support fro the buttons and mic you can use any headset with the phone even a headset from a 1980s sony walkman should you so chose

And they for sure doesn't work! So should be able to be returned...

If you had your phone and earpods replaced under warranty 6 months ago, they would not have a brand new one year warranty. They would have the remainder of the original warranty.
