If so, then did you purchase the device 2nd hand? If the answer is yes, then that means that the device is still Activation Locked to the iCloud account of the previous owner. Only the previous owner or someone who knows the previous owner's Apple/iCloud ID and password can remove the lock. There is no way around this.
If you can return it for a refund, do so, because unless the owner removes the lock, you will never be able to use it.
