You should be able to backup this phone. Do you have an old backup from another phone or iPad? If so go to iCloud.com and try deleting the old device there or buying more storage.
To answer your question if I go to Settings > General > Storage & iCloud Usage > iCloud, Manage Storage > select iPhone > Delete Backup, yes I get the message you are getting.
You would be turning off iCloud backup and after deleting you will have to enable iCloud backups again in Settings > iCloud.
More importantly, why are you trying to delete the backup? Why not leave it as is and change the options for what you are actually backing up? Then doing a new backup with less options if that is what you want. If in doubt better to be safe than sorry.

The reason for why i want to delete the back up is because it takes up most of my 5GB icloud storage. The last back up i done was on my old iphone to get that stuff onto my new one, iv now had this iphone for over a month..

Jul 13, 2016 12:09 PM in response to catcadby elcpu,So as I understand it, you restored the backup from your old iPhone to the new one and the new one is working ok, all restored. If that is correct I don't see a risk in deleting the old backup and doing a new backup from the new one to iCloud. As I mentioned, you may want to consider buying more storage (99 cents/month in the US) or changing what you have enabled to backup under Settings > iCloud so the backup is a bit more under 5 GBs.

Jul 13, 2016 12:19 PM in response to catcadby elcpu,Let me mention something else FWIW. Relying on an iCloud backup for valuable info, like pictures that cannot be replaced, is not a good idea. The advice given here is to import pictures into a computer and then backing up the computer to an external drive. That is what I and many others do. iCloud backups generally work but I have seen too many instances of users losing their data by not having a separate and reliable backup on another device.
