Q: I just picked up a 12inch I pad PRO and purchased a keyboard provided by Apple however I find that the base remains unstable and keeps shaking when you type, the seller tells he it is a design fault. Can anyone tell me if that is the case?

find it difficult to fathom that Apple would be selling such flawed products.
iPad Pro, iOS 9.3.3, 12.9 inch

If the seller is an authorized Apple reseller, an independent business,
you may have to ask if you could see & try a different sample product
because you may be looking at something that has a defect.
{According to the linked Support page, the Type position should be more
stable to use; however if the keyboard is not flat, that sounds like defect.}
Sounds as though you aren't at an official Apple Store (apple retail)
but instead are somewhere else. Could you provide more information?
Some keyboard accessories are made by third party businesses; so
if the product has an Apple product model number on it, note it here.
When considering the purchase of an accessory, it is a good idea to test
and check it in the retail store before buying. An official Apple Store has
a different return policy than an authorized independent Apple reseller.
Not sure if I can be of help; these discussion areas are generally Apple
product users such as yourself, who have taken their spare unpaid time
to see if they can help other product users.
Good luck...!
