I'm trying to upgrade my MacBook Pro from 10.8.5 to the new version of 10.11.6. But it seems is not free for me and asking me for billing info. Could you please explain why is not a free upgrade?

But to answer your question: the billing info might be necessary, but you will not be charged for the upgrade.
Thanks.... But I never asked for billing info for my other Mac products (another Macbook pro, iMac,..) when I wanted to upgrade them.!!

It is free, but you must have a valid payment method registered in the store. In some countries, you can set the payment method to none.
