www.icloud.com you can delete find my iPhone on this site
but you can't delete iCloud on the device, after you deactivate Find my iPhone
the new owner can restore the device.
The previous owner needs to unlock the iPhone. Without the Apple ID password the iPhone is useless to anyone.
If you can't contact the previous owner, try to get your money back.
And avoid ideas suggested by untoward sites online that may propose
that you could unlock an iDevice activation lock or iCloud, through a
service offered online. These likely are illegal and may be out to harvest
your identity or fiscal information.
If you know the owner of record, you may be able to have him help to
restore the function of the device so you can use it: He should have:

Hi
You are describing Activation Lock, which prevents unauthorised use of the iPhone if it is lost or stolen.
This can be disabled only by the previous owner either entering their Apple ID and password on the device or by them removing the iPhone from their devices list in Find My iPhone via iCloud.com.
If you cannot arrange for either of these steps to be taken, then you will be unable to use the iPhone. There is no way around this security feature.
