Photos.app comes with OS X 10.10.3 (that's the third update to Yosemite) or later. What exact version of Yosemite do you have?
BTW: there is no "migration" from iPhoto to Photo Stream. Photo stream is not an app, just a service to save you importing photos manually from some devices.

Sep 1, 2016 11:32 AM in response to DeaconJoeby LarryHN,1 - If you are using El Captain then you do have Photos - it is part of the OS and is in your applications folder, the launch pad and probably in the dock
2 - you can not use iPhoto 8.1.2 with El Captain - it requires iPhoto 9.6.1 and I do not believe there is any way for you to get that now over five years after the release of iPhoto '11 which you never updates to
You either have to use Photos (it is a new program and has a learning curve - take the time to study and learn it or you will be very frustrated) or some other photo management program of your choice - in teh future I suggest you not get 5 years behind on software - it really complicates things for you
