If you are downloading a program that you know is expensive, and are getting it for free, then yes, it is likely illegal.

If you find a program that the author is providing online, and you decide to download and use it under the terms the author has specified, that is not illegal on your Mac. If your software is up to date, it is difficult to install if the author has not signed it with his Apple developer certificate.
