You don't get a refund.  As has always been the case, it is your responsibility to backup your content.

If you failed to do this basic thing, then you can redownload content purchased from iTunes.  Open iTunes, sign into the account, Click Purchases, under Quick links

I did back up the phone, it only backed up 101 songs from the phone saying that the other songs were linked to a pre existing iTunes account and did not back up and then deleted, this seems more like poor programming on apples part, if you download iTunes and sign in with your apple ID why does iTunes not import all your songs form the previous iTunes to the new one? is it a preset scam that apple runs as this is a problem you can google and thousands have this same issue. or is it lazy programming like the lazy and poor quality of the iPhone 6.

a solution is required not pandering with a pathetic response of placing the blame on the customer.

See your other thread: Re: missing songs.

iTunes will transfer media purchases that are on a device but not in the local library if they were made with any account that has been authorised for that computer. iTunes doesn't allow all content to be easily extracted as a measure against casual file sharing. There are workarounds if you take the time to find them.
