When I drag a file from the desktop to an email and send it, I then drag the file from the desktop to the trash but whenever I come to empty the trash (even if it's several days later) I get the error message that that file is in use by another application. I can empty the trash by either quitting Mail or using the Delete Immediately option but surely Mail shouldn't still be using the file?

I tried it and got the same behavior you did. It shouldn't happen, and I suspect it may be a bug in Mail that does not let go of the file. It seems to have been fixed in the Sierra GM.

Or… you could just leave them in the trash until you quit mail. Much cheaper. 😎
Not fixed. MacBookPro 15" OS X 10.11.6 Still does it in El Capitan. Most annoying. Maybe its not "bugging" Apple enough to pay attention.
Thanks for checking in but if you look under my post you'll see I too am using 10.11.6 so we know its's not fixed there. Luis suggests it's fixed in Sierra
