Q: problems with the update and downloading for app store

app store os x yosemite says try again later before i can download the update for 10.10 what can i do so i can open my new laptop that i brought off someone???

Take it back.
The previous owner failed to set up the machine to the original factory settings and your Apple ID never downloaded Yosemite.
