Apple may have some of the 160GB late-2009 model, because that model is still on the list for iPod servicing.

For existing owners of this last iPod classic model, they can pay the "out of warranty" fee and return their non-working iPod classic, and get a working replacement (which may be a refurbished unit or never used). However, Apple does not sell them to new customers. You may find resellers with stock of (never used) iPod classic, with an Internet search. At this point, I would not call them "new"; lithium batteries get old sitting in a box.
NOTE: If you already own an iPod classic, but it's broken due to a faulty hard drive, you can consider replacing it with flash-based storage, in the form of commonly available compact flash card or SDXC card (on an adapter).
