Q: Trouble with .inProgress Time Machine backup

brief summary:
My iMac hard drive was starting to slow up a few weeks ago and it had been ages since I backed up. I ordered an external drive from Amazon and ran Time Machine as soon as it arrived. The backup was nearly complete before the drive completely died (status in Time Machine app said something to the effect of "backup completing" and the drive was nearly full.
I had a new drive installed on my machine and after installing the latest OS (sierra 10.12) I plugged in the extremal drive with the incomplete backup (the only one on the drive). When I navigate through to the .inProgress file and right click to "show package contents" I am able to find all the files from my old drive. HOWEVER, the external drive had been formatted as CASE SENSITIVE and now I am unable to copy files from the external drive onto my new internal drive.
Can anyone advise on this?
