So I currently use iCloud photos. I just reset my phone without a backup so that I could start fresh. I have deleted my photos multiple times now and they keep restoring. I still want to use iCloud photos but want to start fresh and get rid of the old ones. No matter what I do they keep coming back. I have made sure my photos stream is unchecked and this is the only apple device that I own so they should be in photo stream. Any ideas?

You need to remove them from iCloud.
Now, every time you turn iCloud Photo Library back on, they download from your iCloud storage to your phone. This is how it is designed to work. Nothing to do with Photo Stream. Sign in to iCloud.com with your Apple ID and remove photos there if you no longer want them.
I signed into iCloud through website and phone. They are not on thr website. It just tells me I have 13 days to recover these photos before they are permanently deleted. I am signed into iCloud through phone and every time i delete them they come back.
