Sorry, but if your device is Activation Locked, then only the person who put the Lock on, or someone who knows that person's Apple ID and password can take it off.

If you can get a refund, do so. If not, then you are stuck with a brick.

There is nothing you can do without the original owner (or the person who locked the device) assisting you. If you can not contact them you can not use the Apple ID password
