It may have been unopened and still sealed in the box, but if purchased from an unauthorized reseller, it cannot possible be new, as in never previously sold at retail. Unauthorized sellers have no legitimate access to Apple OEM new, never sold, products.
The 16GB iPad Air 2 was discontinued by Apple over 6-7 months ago now. Simply buying a device still sealed in the box, from a non-authorized seller, is no guarantee at all the device is retail new, as unauthorized sellers have to get their stock by buying used devices, or salvaged devices, or gray/black market items, or fakes. And if they are selling used items they purchased still sealed in the box, the warranty has been running down ever since the first buyer purchased that device.
You can check if that seller is or is not an authorized reseller at https://locate.apple.com/ro/ro/ (if they are not listed there, they are not an Apple Authorized reseller). You can also call Apple support in your country and ask them about that device and its serial number - see Asistență Apple oficială for contact information.
Actually, the warranty starts the very day of original retail sale by Apple or an Apple Authorized reseller. Even if never activated and never taken out of the box, the warranty is counting down, one calendar year from the date of sale.

If you purchased a used device, yes, the original manufacturer's one year warranty may be over. The warranty starts the day of the original retail sale of the device when new.
