New iphone 6s from ebay

Hi, i'm new to apple and so was unaware of buying apple products from apple store only... so i ordered an iphone 6s from ebay and its on its way... They listed the product as 'New Apple iPhone 6S ....'


But when i contacted the seller, they said "The said item is brand new, unused and undamaged. And the product is not a refurbished one. The phone comes with generic (compatible) accessories and sealed with compatible box."


So the phone is not in a 'Factory sealed box'.. The item is not yet received... so i was planning to return it and claim on ebay against the seller under "Product not as described".. but for that to work i wanted to clear few things,


i was wondering :
1) Do Apple sell iPhone with out a sealed case for the online shops to fabricate their own packing..?

2) Does 'Brand new iPhone" in apple product description means
a) the cell phone unit alone or
b) the whole pack with the cell phone unit+accessories+sealed box

If it is being sold on eBay in the first place, it cannot be retail new. There are no Apple Authorized sellers on eBay, so no seller there can possible have a retail new unit (I.e. a unit that was never previously sold to a retail customer). So by definition any iPhone on eBay is used.


A Seller may be selling an iPhone that has not been activated by anyone, but that does not make it new. It would still technically be a used unit. The warranty begins on the day of original retail sale (sale by Apple or an Apple Authorized seller who has wholesale access to Apple products) and has nothing to do with activation.


There is no way to check a device's activation dates or how many times it's been activated by anyone, or even whether it has ever been activated by anyone.

the phone had to be purchased from an Apple Authorized Retailer if it's genuine, and if so the warranty started the moment it was purchased by the original seller. If it was a year and a day ago that warranty is completely expired. If thats the case and the phone ships broken - hermetically sealed in the box since it left the assembly line - too bad the warranty expired, Apple will not help you under any circumstance whatsoever.


If the device has a lock on it and the original owner can't be contacted or wont give you the info either will Apple, not for any reason and a receipt from eBay or some other not-Apple reseller is not going to constitute a proof of purchase for Apple. BTW the list of non-Apple resellers includes Amazon, the largest internet reseller on the planet, they are not qualified to sell devices as "new", even if they were never taken out of the box by anyone.


If you are okay with these caveats then you can buy a phone from an unauthorized retailer such as Amazon and the vast majority of on line only sellers. Otherwise Apple authorizes phones sold by Apple, Best Buy and Walmart and a handful of cellular providers among other business.

There are no Apple Authorized resellers on eBay. Since Apple limits their OEM wholesale distribution to only their own stores and those of their Authorized Resellers, no eBay seller could possibly have a truly retail new iPhone. They must be selling previously purchased, outright used, salvaged or illegally obtained iPhones.


Whatever you purchased, it will not be a "new" device - it cannot be. It might not have been activated and used by anyone, but if legitimate at all, it must have been sold at retail previously by Apple or one of the Authorized resellers.

Thanks Jimmy... in the seller item description, they are saying,
"Apple does not provide International Warranty for any of its iPhones and so you will not get warranty for this phone (as this is an imported one) from the Apple service center. But the phone has 30 days of eBay Guarantee + 6 months of seller warranty."


Anyway i'm planning to return it to ebay for refund.. i think, in my claim i can put forward the wrong title ('new iphone') they used... and buy one from an apple store..

Hi

No accept from courier service tell seller you are going to return iPhone

DONOT open parcel tell Ebay you are going to return

Some iphones on EBAY have been refurbished but the touch I'd does not work that's why they are cheaper.

Try to buy one of just one person who is upgrading with box

But you will need to pay the postage to return.

Let me know what happens.

Apple does not provide an international warranty for iOS phones, but more importantly Apple provided the 1 year warranty to whoever first bought the phone from an Apple Authorized reseller. If that seller bought the phone a year and day ago any and all warranty from Apple Computer has expired if the phone was used or not.

What eBay offers after that is entirely eBay.

buying from the Apple store is going to give you the peace of mind that if you run into a problem you own the phone, you deal with Apple and they are generally pretty good about hardware issues. Just ask them what the cover and don't cover so you are clear on it and no surprises afterwords.

Thanks a lot guys...

i sent them a detailed message with everything i got from this discussion.. They tried to defend with the 'Generic Accessories' part in their item description, but got silenced by the 'Title name : New iPhone', 'Broken Factory Seal' & 'No Apple Authorized sellers on eBay'.


Finally they agreed to Refund and asked me to 'Refuse the shipment on arrival'.. i also sent a message to eBay describing the matter asking the actual Refund procedures. Waiting for their reply.


i'll update the developments..

Hi Brian, Jimmy , Michael,
So i received the shipment.. eBay asked me to accept the shipment so i did that, and i made a complete un-boxing to re-boxing video and informed them(in case of any further fraud attempt)
As suspected the phone was not new, it was even a used one. Call time>Life time was more than 11hrs.. also its ringer button was faulty.. body looked really nice with no scratches but something was off..
Anyway, i raised an eBay claim. it took around 20days. Today i got the refund..
