You can't use it. Only the original owner knows the password and Apple ID to unlock it. It is likely stolen, in which case you should turn it over to the police.

Then you've (hopefully) learned a valuable lesson from this experience.
I'm sorry to hear that but you have been scammed. Next time be more careful and don't buy stuff from strangers.
