Hi. You need to erase the iPad by following the steps in this link: What to do before you sell or give away your iPhone, iPad, or iPod touch - Apple Support. Also, your husband needs to login to appleid.apple.com and remove the device from his account. You'll need to recover the Apple ID password in order to do that.

Until you remove your husband's Apple ID from the iPad, you can't proceed. So, if your husband can't recover his Apple ID password, you'll need to take the original purchase receipt to Apple and see what they can do.
