Commercial use of Final Cut Pro from bundle for education

Hello there,


Can i use content created with Final Cut Pro from education bundle for commercial use? For example: monetizing video created with FCP on YouTube.

AFAIK the terms of non-commercial only apply to the software itself not to content created from using the software. So you can create a movie and charge admission to see it or to monetize the viewing of it. This applies to both the standard license and to the educational versions.

This is also true when creating music from GarageBand or Logic... or slideshows, etc…. Apple also gives royalty free usage of things like sound files, but retains the rights to the actual loops/sound files.

In other words, you cannot sell (commercial usage) the software or the sound files themselves, as repackaged, stand alone software/sounds, but you can use the software/files in a project/movie that is a commercial project.

Otherwise there would be no movies, songs ever sold that are produced using Apple products.

The educational and regular version both have the same license agreement clause:


The Final Cut Pro X license agreement states:


“…you have the right to use the Apple Software as permitted by the Mac App Store Product Usage Rules set forth in the App Store Terms and Conditions (http://www.apple.com/legal/itunes/ww/) (“Usage Rules”), and are granted a limited, non-transferable, non-exclusive license:

“(i) to download, install, use and run for personal, non-commercial use, one (1) copy of the Apple Software directly on each Apple-branded computer running OS X (“Mac Computer”) that you own or control…

“(ii) if you are a commercial enterprise or educational institution, to download, install, use and run one (1) copy of the Apple Software for use either: (a) by a single individual on each of the Mac Computer(s) that you own or control, or (b) by multiple individuals on a single shared Mac Computer that you own or control. For example, a single employee may use the Apple Software on both the employee’s desktop Mac Computer and laptop Mac Computer, or multiple students may serially use the Apple Software on a single Mac Computer located at a resource center or library.”


So, you can't use the educational version for selling video to clients, and I guess that goes the same for the regular (full paid) version as well? Doesn't make sense to buy the full version if you can't sell the videos created.

I'm not a lawyer, but have always read

as meaning you can't download a copy of FCP-X to a laptop you own, or for that matter 10 copies to 10 laptops you own and then rent the copy out as a business.

FWIW, that's my understanding of "non-commercial use".
