I want to use migration assistant to migrate from an old MacBook running Mavericks to a new MacBook running Sierra. If I use the Time Maching backup from the old machine will that also change the OS on the new machine back to Mavericks?

I want to use migration assistant to migrate from an old MacBook running Mavericks to a new MacBook running Sierra. If I use the Time Machine backup from the old machine will that also change the OS on the new machine back to Mavericks? If so, how can I avoid that happening.

MacBook Air, macOS Sierra (10.12.5)

No. Migration Assistant will not downgrade the operating system.
