Photos stuck "Uploading 5 items"

Hi, I've seen a few similar problems but none of the solutions seem to work. So at the moment its stuck on uploading 5 items and I don't know why. I have turned iCloud photo library on and off again, with no luck. I have created 2 smart folders one with referenced photos which has nothing in it and also one with items unable to upload to the icloud, so I exported them as shown here Check the status of your library in Photos for macOS - Apple Support, as of yet I have restarted the photos app and have not reimported them but it is still stuck on 5 items and I have no idea why, it has been like this for the last couple of days, thanks in advance.
