So I bought myself a new iphone 7 and synced it with my icloud account to transfer photos from my old iphone 5. The problem occured when I deleted photos from iphone 5 (so i could give it away) and noticed photos from my iphone 7 were also deleted.
How do I get back my photos?
I want them to be only on my iphone 7.
P.S. They are deleted from the "Deleted photos" album too.

You don't. Unless they were backed up elsewhere.
You should have simply erased the old phone entirely instead of deleting everything from it.
If you don't have an iCloud or iTunes backup, your content is gone. By using the iCloud photo library, your photos were not in either of those backups.
