What part of my answer is unclear? IF you have AppleCare Plus, then YES, it is covered, but you will have to pay a $29 deductible.
If it's not a defect, then it's accidental damage. Make an appointment at the genius bar and take it in to show them. They will explain your options.
Well, the phone did not scratch itself.
Have you tried removing the screen protector you have installed to see if face id works without it there? That is the first thing Apple will do to troubleshoot that problem.
There is a $29 deductible to have the screen replaced if you have AppleCare+.

The first I went for a replacement it had dust in lens second time I went since phone froze then third I went for a scuff in the back it was cosmetic but the face ID scratch just showed I didnt even do anything to it.

I would suspect the screen protector you have install is more likely to be interfering with face ID than the scratch is... Try removing it. If the problem is the scratch, the display will have to be replaced.
It would not be covered under the standard warranty. You will have to pay to have the screen replaced. If you have AppleCare+ the deductible is $29. If you do not, screen replacement is $279. These are US prices.
