Apple's policy and terms clearly state that a replacement iPhone may and likely will be a Refurbished unit. There is no guarantee it will be a new model.

If you decline such a replacement, you simply do not get one. There is no legal requirement from Apple to grant you a new device for a replacement.

Model Numbers for Refurbished iPhones start with the letter F. You can find the model number in Settings->General->About->Model.

Beyond that as has been explained, Refurbished units go through a much more rigorous part replacement and testing phase than new ones. In most cases getting a new screen, and back plate, as well as new or as new replacement parts to any internal components that may have failed.

For all intents and purposes any replacement iPhone you get will be less prone to issues than a new one. And there should be no functional or operational difference between a refurbished unit and brand new one, as they are refurbished by the same people and with the same parts as new ones.

Apple One (1) Year Limited Warranty

If during the Warranty Period you submit a claim to Apple or an AASP in accordance with this warranty, Apple will, at its option:

1. repair the Apple Product using new or previously used parts that are equivalent to new in performance and reliability,

2. replace the Apple Product with the same model (or with your consent a product that has similar functionality) formed from new and/or previously used parts that are equivalent to new in performance and reliability, or

3. exchange the Apple Product for a refund of your purchase price.

You turn it on, activate it, and if it works, it could very well be refurbished. A refurbished iPhone from Apple is inspected closer than the factory manufactured devices. All parts are replaced as necessary and the device is tested multiple times to ensure it works, and it comes with a warranty. You really couldn't tell if it is refurbished or not by looking at it, although there are some articles floating around that serial numbers that begin with, or contain certain letters are refurbished. I cannot independently verify that information.

My recently purchased T-Mobile phone has an intermittent audio issue. The store was going to replace it with a refurbished one, which I refused. After talking to T-Mobile Support, they said that they would replace with a new phone, but how can I be sure. We had the problem from day one (issue was confirmed by store personnel) and had apple reload software run diags on the unit which did not find any errors or fix the problem.

So, you returned your problem device to Apple to be replaced? How old was this phone when you experienced this audio problem? What exactly was the audio problem?

Warranty replacements from Apple can be new or refurbished, as indicated in the Warranty information that Apple provides. As I indicated in my earlier response, the refurbished devices contain new parts and are more extensively tested than new phones. They also come with a new phone warranty. You wouldn't be able to tell a refurbished device from a new device.
