When you erase an iPad from find my phone does it erase and restore to original software or just erase?

I've done it before. It erases everything such that the data can't be retrieved. However, I needed to enter my Apple ID and password in order to unlock it. At that point it can be restored to factory settings or restored from a compatible iOS backup. It might even be possible to restore from an iPhone backup.

Well - I don't recall if "factory settings" meant exactly like the factory or with the latest version of iOS.

You don't have to give them your password. Login to iCloud.com, or use Find-My-iPhone, to erase the iPad, then remove it from your account.

Did you purchase it from someone fairly local? I think it's a pretty fair trade if they returned your money that you might go in person to unlock it. If it was mail order I might agree if they would send it to you with a return label so that you could unlock it and return it.
