My battery is lieing
Why is the battery at 1% if realy at 40% because every time it dies I turn it back on and it is at 4%

The battery is most likely failing. Get the Apple Support app from the app store and use it to contact Apple Support. They can do a remote diagnostic, and schedule a genius bar appointment to get it replaced if needed. Or get the app Battery Life, which does a pretty good job of reporting battery condition.
