Just downloaded a new iphone from iCloud . One if my apps has disappeared, apparantly no longer in the App Store . Lost a whole lot of foes and photos !

This is most probably the doing of the App Developer. It could be due to bug fixing, updates, or violation of Apple’s terms. Try contacting him/her and ask for more information regarding what happened.
If an app is no longer in the App Store, an iCloud restore will not be able to download those apps again. It is up to the developer to make sure their apps are updated and remain in the App Store.
As far as photos go, did you have iCloud Photo Library enabled on your old device? If so, make sure it’s turned on in your new device. Also, it can take some time for all the photos to show up on the new device.
