Firstly you are not talking to Apple here: this is a user to user forum which Apple doesn't participate in. Secondly, as you know the Activation Lock is an anti-theft device which has been quite successful in reducing the number of thefts, so it would seem unlikely that there will be any move to remove the facility. However you are if you wish able to transmit your thoughts on the subject to Apple at https://www.apple.com/feedback/

Here are some solutions for you:

1. Don't purchase iOS devcies from sources that are unknown to you, that you have no way of contacting after the fact, or off the street. If you are going to purchase from a third party, use a reputable source like eBay or Amazon.

2. Check the device to see if it is Activation Locked: Find My iPhone Activation Lock - Apple Support(see the section titled "Check for Activation Lock before you buy a device from someone else" - follow ALL of the steps in that section).

Those are the solutions for your problem. If you follow them, you won't get stuck with an Activation Locked device again.

not all second hand iphones are snatched or stolen

Although true, one would think an owner of a device who is knowingly passing it on through a private sale would take the 60 seconds required to turn off the Find My Phone feature, which is what creates and enforces the Activation Lock.

A safe assumption is that most activation locked devices for sale are so without the previous owner's knowledge or permission. Call it what you wish.

Understandably, Apple, Samsung, LG et al want no part of finding out why or providing a solution.

If not stolen or lost, activation locked devices came from an owner who did not think about whomever will purchase their used device in the future.
