Unfortuntely my son was killed last week. We have his phone but it is passcode protected.
Does anyone know how to access it without restoring the phone? We would like to access his photos to retain the memories.

I'm afraid that it's probable you won't be able to do so - I gather you've already asked Apple: you've nothing to lose by taking it to an Apple Store but you will probably get the same answer. As Franz suggests above, try iCloud if you have the Apple ID: the photos might be there, or even a backup (note that restoring that will replace everything in the phone you restore to).
Unfortuantely it's technically not possible. If you know his Apple ID and password, you should be able to retain the photos from iCloud in case iCloud Photo Library was enabled on the device.

I called Apple but they can’t help. Do you know for definite going into the store that they can get it to work?

Apple can help with Activation Lock in this situation, but not with the passcode because it's stored only on the phone.
So does this mean that they cannot get into the phone at all? All we want is the photos to cherish.
