Without assistance from the previous owner who set the Activation Lock there is no way you will be able to release it.
Return it for a refund of your money. If they hesitate to return your money, try suggesting fraud on their part.

Thanks for reply. I guess I am just out a phone. I bought a couple years back and was using phone a very long time. One day it just cut off and when I turned it back on it requires his iCloud information. I guess he never removed the device before selling. So thank u, I was hoping to sell since I've since updated my phone but I suppose it's useless since it can not be gotten into.
About the only thing it is good for now is recycle.
Did to prior owners turn off "Find my Phone?" If not, they should be able to go to iCloud and select and remove the device. Without be able to do that, I'm afraid you're dead in the water. Perhaps someone else has an idea. Good luck.

So I bought an iPhone 5 off of Facebook amd I have reset it but it's asking for the previous owners iCloud information on the activation lock screen and I can't get into the phone to use it, anyone that can help me please!!!??
