I have a passcode locked, disabled iphone 5s. I just want my photos back, is there any way around the reset back to factory settings as the only option, and lose my photos.

If it's disabled it's too late to copy anything off it and/or to take a new backup of it. Have you got a recent backup of it that you could restore to so that you can copy the photos (that were on the phone when the backup was taken) off it ?
