Ya I’m having the same problems the ear speaker works fine on calls but when on YouTube or intagran or anything the ear speaker does not work only the bottom one does. I hope this is not a hardware issue as I just spent $1249 on the iPhone XS Max.

I have returned 2 Xs Max phones already. The 3rd one is having the same issue. I can’t keep returning phones. Apple should fix this or at least acknowledge that it’s there and let us know when it will be fixed. I paid $1250 for a device and I expect it to work properly. All facets.
That should not be the case; you may want to make a Genius Bar appointment to have your phone examined.
Don't worry; if it is a hardware issue, that's why there is a factory warranty.
You can verify how audio is supposed to work on any of the demo iPhone XS/XS Max models on display in the store.
There appears to be a bug where an unknown event will cause the upper speaker to go silent; rebooting the phone should restore proper operation.
You may want to try the procedure mentioned above to do a soft reset if the reboot doesn't restore the speaker, but I've yet to have a reboot not work.
If it does not, you may want to schedule a visit with your local Apple Store's Genius Bar to have your phone examined.
I am using an Iphone XS Max 256 GB and I too have this problem. I first noticed it when I was playing PUBG Mobile and I wasn't hearing sterio audio. I'm IOS 12 (not the beta) and a restart is a good solution. I hope it is just a software bug that can be resolved.

I have checked on different forums and it seems many users are reporting this problem and it seems to be software related.
Try to have a clean restore via iTunes and do not immediately restore your backup.
Once your iPhone is freshly restore do a test with whatever video or music. It should work.
I am having the same issue. My first Xs Max arrived on September 27th. By the 29th, the speaker in the earpiece had failed. I took the phone back to the Apple store on 10/01. They ran a hardware test. The Mic failed, the receiver failed and the speaker in the earpiece failed. They tried to reload the software and that failed. They gave me a new Xs Max. Today, a day later, the speaker has failed on the new device. Apple support had me do a restore via iTunes. After 3 attempts, the restore finished. The speaker works but I fully expect it to fail by tomorrow. I will more than likely return the phone and continue using my iPhone X for a few months until these issues are fully resolved.
Really irksome pain in the balls. It only works immediately after a restart and at some point afterwards it just stops.
Phone calls work fine, but music only works after a restart.
Bottom speaker works fine.
I am experiencing the same issue. Bought my iPhone XS Max 256GB Gold on the Sunday after the launch day (Friday). I am running public beta iOS 12.1 so am not sure if it is related to that. The top (earpiece) speaker stops functioning during music or video playback during random situations. I have been unable to duplicate it manually. You are right that a reboot solves it or even a simple shut down and restart solves the issue but only temporarily.
I use the following regularly-
iOS 12.1 Public Beta
CarPlay
Facetime
Bluetooth devices
Skype for business
and various other apps
It's difficult trying to narrow things down what is ultimately causing this or is it that the speaker is defective. Not sure. The last occurrence was right after I disconnected from CarPlay. Shut the car off and disconnected my phone and the speaker was out.
Is it limited to 256GB Xs MAX? Is it the Beta 12.1? Is there an app that causes this?

Im also facing the same problem with my new iPhone Xs Max that i baught just 1 week back, when im playing music only down speaker is working, top speaker does not work but when im on the call it work fine,
When i force restart it work fine for some times and after that it does not work again,

Back your phone up. Log into iTunes from your Mac or PC and do a Restore using iTunes. Make sure you have the latest version of iTunes. Log out of iCloud on your phone then do the restore. Mine has been working for 3 days straight.
I am having the same issue. The reboot is a temporary fix, but it just comes back. No sound out of the ear piece speaker. It may be happening in between Bluetooth connections. I connect to my car and then I’ll play a YouTube video and notice the sound being gone except the main speaker. This is too annoying to have to reboot just to fix it. I imagine it’s just a software issue, but a small update would be great in the very near future. I heard people using the updated version of the beta are still reporting issues with it.

You mentioned after restoring via itunes , your phone is working fine for 3 days ( this was posted on the 5th of October), but your post on the 8th shows you are still frustrated cuz of returning 2 phones and the third has the same issue. My question is : did the top speaker failed again after the fresh itune restore and after going well for 3 days staright ???
