Have the previous owner of the device go to https://iforgot.apple.com/password/verify/appleid And click on ‘forgot Apple id’ after they figure out their Apple ID, have them reset their password. Once that is completed have them log into find my iPhone and remove device from account, or have them go online to iCloud.com/find and turn off find my iPhone activation lock.

They are going to have to try and recover the Apple ID. Only they can remove the lock. Return it for a refund until they can remove it. If they bring the original receipt and the device to a physical Apple store, they can ask for assistance. You cannot do that, since you are not the original owner. Once they get the Activation Lock removed, you can see about purchasing the device, otherwise it is useless to you. Activation Lock cannot be bypassed.
