The previous owner has to release it.
It's best you return it for a full refund, since it will be useless to you.

Ask the seller to remove the lock or give you a refund, or if applicable, ask the people running the site or store you got it through for a refund.

Apple won't help ANYONE defeat the Activation Lock on ANY iDevice.
They can and have removed it for the device’s original owner, or for the device’s legal owner if the first person is dead, and in at least one case, for someone who got it at a police auction.
