I was wondering if Apple gives you a new set of earpods if yours stopped working. The ones I have I got with my phone so I was wondering if I would have to buy a new set of earbuds

Depends. If they show no outward signs of damage or manhandling, and the issue can be attributed to a manufacturing defect Apple can replace them for a new pair under Warranty yes.

If they are clearly damaged by use, then no.
