Apple's warranty covers manufacturing defects in the iPod and support for problems which occur in normal usage. It does not cover accidental damage to the iPod, including it being dropped, or loss or theft of the iPod; some third-party insurance packages may cover these. You should contact the police about the theft if you haven't already.

SOME credit cards actually cover theft or loss within some amount of time after purchase... You might want to check with your credit provider IF you bought the iPod with a credit card.

you can also call apple at 1-800-MY-APPLE and give them the serial number (listed on the box). In the event someone calls for support, they will notice at that time that the ipod is considered missing or stolen. For the time being, apple will not check to see whether an ipod has been recorded as missing or stolen at any other interaction (during an itunes request or firmware update). That's not to say things couldn't change.

As mentioined from earlier post the nano warranty dos not cover stolen property.nor does it offer replacemt for stolen property. on what to do regarding a stolen ipod go to the link below.

http://docs.info.apple.com/article.html?artnum=300066

THe only thing you can do is report the stolen property to the local police adn hope that its returned. Take this as a lesson and buy a new one.

But Apple will still assist in the call.
They will not refuse the call or service and will not report anything to anyone.

How to report lost or stolen Apple product?
"Apple does not have a formal flagging process for reporting stolen property. If you have lost or found an Apple product, please contact your local law enforcement agency to report it."
