Error Code -34 While loading blank DVD-R

I am trying to make a backup DVD data disk and when I insert a blank DVD I get this message after the "You inserted a blank DVD..." message.

"Buring the disc cannot proceed because the startup disk does not have enough empty space. To burn the disc the finder needs space on the startup disk equal to the size of the disc. (Error code -34)"

It ejects the dvd right before I get the message. This is also an aftermarket Super drive.
