Allow me to enlighten you on the ways of US law. Certian laws are set by the state govt and certian laws are set by the national govt. Drinking age and driving age are set by the states. The national govt influenced those laws with funding but those laws were still in the states control. Behringer's example of Louisiana shows that.
There are some laws set by the national govt that states to no have the ability to overturn or adjust. Up until a few years ago speed limits were one example. Currently the federal income tax, draft age, voting age, etc are all examples. These laws are set by the national gov't and the states have no power to deny them. It is in this very important area that the EU nations and the US differ.
And, as they say, the difference is all the difference.
