Apple background imagery

I have been approached by a client who wishes to have a kiosk built for trade shows. They want to use an iMac for the presentation. Also, the design they want to use contains the default background used in OS 10.4. I could understand them using this image for an internal publication, but using it in corporate marketing seems legally unsound.
