Is OS pre-installed on MB? (Or Craiglist scam?)

I'm about to buy a newer Macbook off craigslist. The guy is selling it to me brand new in box for $140 off retail, not to mention I pay no tax. I e-mailed and talked with this guy many times and went over my conditions for buying this. The concern I have is, it's new in box. So I told him I would buy it if he opened it and preinstalled the OS, so I can try it out at the bookstore (our meeting place).

He said the OS is preinstalled, so I can open up the box (at our meeting place) and try it out. Is the OS preinstalled on Macbooks? I can't remember when I bought my first Macbook if it was.

Macbook, Mac OS X (10.4.10), Hitachi 7K200, 2GB Ram

Yes - the computer is ready to go out of the box. As already mentioned, be sure that the computer comes with the restore DVDs and that the owner has a store receipt for the computer. Mac notebooks are the hottest item on the theft hit parade and there are a lot of them being sold. If the item you buy is stolen it could come back to bite you later. (Apple doesn't track stolen computers but police DO distribute serial numbers of stolen computers to local computer stores.
