iphone refund policies in egypt

Hi,

I've bought an iphone about 7 days ago from a Vodafone store in egypt, and after 30 minutes of activating it I got no-service on the phone, I went back to the Vodafone store but it was closed (bought it near 10,30 PM), the next day I went to Vodafone and they said they will send it to apple store to check whether it has been jailbreaked or not (and it was, Oh my god, I didn't even make a phone call with it, and you started with thinking that I might have jailbreaked it, after long debates I agreed to hand the phone to the Vodafone agent, and they said it will take from 3-4 working days to check about that, and if Apple found that it's an hardware problem they will hand me a brand new package.

When I came back to vodafone after the 4 days they wanted to give me the new device with the old package, I refused and said that all the vodafone agents I've met till now said they'll change the whole package, I said I wanted to return the iphone and getting a refund instead.

Here in Egypt, CPA (Consumer Protection Agency) which is a governmental agency that have authorization over every seller in Egypt, says that you have 14 days to have a refund of any product in Egypt and they told us that vodafone is trying to waste time on us.

Vodafone says it doesn't return any iphone and that is by an agreement between them and Apple, I said that it's your problem cause you didn't write a notice about that in all of your documents and ads, I contacted customer service of Vodafone many times, but they refuse to even contact me with a manager or some principle in the company.

I contacted the apple authorized seller (BestBuy Corp) here in Egypt and they said they don't have authorization over Vodafone and they can't help me, and that iphones being brought to Egypt by an agreement between Apple US and Vodafone Egypt, they even advised me to contact Apple US about this issue, and they maybe help me (and I don't know by the way how to contact them, and whom may I contact)

Vodafone says it won't do anything for me and I have to take that phone, even If I wanted to return it, and that CPA can't make anything to them.

What do you think I should do?, 7 of the 14 days is only left.
I don't know who can help me, Vodafone refuses to give me my money, and the Apple authorized seller told me they can't do anything.

The whole matter is I can't trust that the iphone they want to give me is a brand new, they wanted to give me the phone without a package, and they say that it arrives from apple us that way, without a package, and that apple manufacture some iphones for sale and some iphones for replacement, and the replacement ones doesn't came in packages which is very funny, apple can't do anything like that I think.

Any franchise in Egypt is known to be untrustworthy.

That's true, I declined it because they offered only the replacement device, it wasn't in a plain white box, and it wasn't in a new retail package, instead they wanted to give me the old box(with the old serial number) and the new device only.

I've read over internet in many places that if it's not in a retail package this would mean that the iphone is a refurbished iphone, do you think this is true?

I bought Iphone 3g 8 gb from vodafone too 20 days ago , and itis obvious that their iphone 3g customer service is pretty ***** , they are so ignorant about anything related to iphone 3g , and believe me ..you'll never be able to get your money back from them ...so here what you shall do in my openion ..

since itis very difficult to contact apple as you're main support is your carrier which is vodafone ... so don't think that Apple would do anything for you ..

so

don't forget that you've a one year warranty , so why don't you accept taking the device that vodafone wants to give you ?? take it and start using it , and if you feel that there is any slight defect in it , return it back to them and they are obliged to change it for you... so look at the full part of the cup , since you can't get your money easily ...accept that iphone and test it , and who knows ?? insha'allah it will work like a charm , and if it doesn't , they are obliged to change it under warranty ...

and about the CPA , don't expect much from them ... unless one thing ... which is (shoof wasta m3ayana aw zabet rotba kbeera or anything like that ykalem el cpa , sa3etha bas momken y3melo 7aga fe balad el koosa di)

Ahmed, so if I understand correctly you're upset that the authorized Vodafone is not willing to replace the retail packaging but is willing to replace the defective iPhone 3G with a new one. This doesn't make a lot of sense. Apple's warranty program covers parts and labour to repair a defective iPhone or swap it for a refurbished one. I doubt the dealer is giving you a new iPhone especially when he/she is not giving you one in a shrink wrapped Apple iPhone 3G box. Anyway, check the paperwork that you got from the dealer. Most carriers have a buyers remorse policy on the products they sell. Meaning you could return the iPhone to the dealer where purchased for a full refund as they sold you a DOA (dead on arrival) or defective unit. This return policy varies from carrier to carrier but most are a minimum 15 days and some have a limit on how much usage of voice, data and SMS can be used before the customer voids the option for buyers remorse. Here in Canada Rogers/Fido authorized dealers have the same return policy of 30 minutes usage or 30 days. Once passed that point the customer is only entitled to a refurbished swap for the same model under the manufacturer warranty.
