Warranty Eligibility on New, Sealed-in-box MB133LL/A 2008 MBP

I found a brand new, sealed-in-factory-packaging 2008 MPB for sale, model number MB133LL/A, one of the last models before the unibodies.

The seller is a company, though not an authorized Apple reseller. Thus, I was concerned that despite being brand new and sealed, the machine's warranty would have already expired while in the possession of the non-authorized reseller, in which case I'm not interested.

I emailed him, and this was his reply about the warranty coverage/eligibility:

initial purchase date. The warranty would then begin from that point and
also allow purchasing of the AppleCare extended warranties.

I know this sounds unusual and I was was told by Apple that it is exactly
that. They did say however that since there is no initial purchase date,
there would be no date for them to dispute and they would have no reason to
deny it. I do have the contact information for the presentative that told
me this and would be glad to call them with you on the phone if you needed
to hear it directly from the. Additionally, if you were to purchase this
item and this not be true, or if Apple were to not allow it from any reason,
I'd be happy to take the item back on return as long as it is left unopened
(the unit can be registered without being opened by using the serial number
on the other box).

Feel free to give me a call if you wish. I just want to make sure you know
that it's an unconventional means of getting the warranty status, but I'm
assured directly by AppleCare that is it perfectly acceptable.

I was wondering if anyone could verify that this is indeed true, and that the machine indeed would have a standard one year warranty from my purchase date, and also be eligible for three years of AppleCare...?

You would really have to ring Apple to get a clear and definitive answer on that, puma.

We are but users here. Yes, Apple do have a process where the warantee is generally based on the purchase date , rather than the date of manufacture, but we would all just be guessing about how they would deal with a situation like this.

Quite apart from anything else the battery in the computer will almost certainly be unrecoverably dead after this period of time (and will certainly have been at least badly damaged by no-use and non-charging) , and Apple are unlikely to be keen on replacing something like this that could be clearly foreseen in such a situation.

If the seller was an AASP I wouldn't be so wary, but I think if you decide to buy it you should assume that if warranty claims need to be made they will probably prove very difficult to obtain. I also doubt that you will be able to obtain AppleCare on it, though they may 'stretch a point" to provide coverage for a two year period from the anniversary of its manufacture or the like.

But only Apple can really tell you (and they don't reply to questions like this here) . Ring them, and if the person who you speak to says "yes that's fine" then get them to put it in writing.
