Data Roaming Charges when Data Roaming is turned OFF - o2 UK

Recently I was stuck in Barcelona for work thanks to the Icelandic volcano which closed international airspace. The iPhone was an absolute godsend: Barcelona's free citywide wifi service kept us abreast of travel disruptions. When I returned to the UK, I found that I had been charged by my service provider o2 for "mobile internet browsing and downloads." Given that I had international roaming switched off at all times, I queried the charge.

Here's the bit you may not be aware of it. I was told the following, verbatim, by a member of staff at o2's "iPhone department":

*"o2 advises iPhone users who are abroad always to switch off their wifi connections after every use, even when connected to free wifi, because sometimes this can turn roaming on and incur charges."*

I was not aware that this was an issue with the iPhone. Having owned it since version one and travelled widely in the US and Europe, I had not experienced this "problem" before.

So: 1) is this information accurate? And 2) if it is not, is Apple happy that an international partner is propagating this nonsense?

Let's just look first at Apple. If you have an HTC, the data roaming is a different function and you can switch it off. iPhone functionality is at fault. So firstly, there should be a discussion with Apple. Secondly, I don't understand how you can open an account with anyone and they give you virtually unlimited credit - it's like giving someone full access to your bank account. As someone who has paid T-Mobile £890 for data roaming that was unintended and unasked for, how can it be lawful to NOT put a stop to the account. How can T-Mobile give you a credit limit of £525 that is so hidden in the terms and conditions that you can't even find it and have no idea you have signed up for it. And then they allow you to exceed the limit and tell you that it can't be used as a credit monitoring device. I'd like to see any other business that would permit this. Another thing is that they probably pay around 1 to 3p per meg, and they charge you £7.50 - extortion to say the least. The whole system is flawed and Ofcom is at fault for not putting a stop to the practice. They have regulated the EU calls - why is the rest of the world not included? I'm sure that this is a case for a class action suit. Any lawyers reading this? Comments please.

Did you resolve this, I have just had the same issue and posted a new thread as initially I didn't see this thread until I saw the link in the Guardian....I am really angry at o2, but it could also be a software clitch...?


I agree it's not about the money, it's about the principle...also it coudl keep happening. I do not want charges for something I have not used and abuse from the 02 "support" team every time i complain. grrrrr driving me nuts!

Hello all


I worked for a mobile company for years so I know how to challenge them. First off all log an official complaint with customer services and make sure you keep the original reference number. Lets face it without being degrading this is way above customer services however if you show you have followed procedures it is more favourable. When you call customer services insist this is raised as a complaint as you need the reference number. Wait for about a week and once they have come back to you with the normal script blurb then ask for a copy of your network TOLL records, these are the foreign networks version of the billing data, the data is sent over every week as it takes a few days to collate. By law you have rights to see this data, should they say they cannot supply you with this then they might as well be plucking a charge out of thin air. Once they have supplied you with this info go through it with a fine tooth comb it WILL show you all the data you have used or call charges. You then need to email Direct to the Managing directors office of your network provider. All emails that are address to the managing director Have to be answered.


Make sure the email includes the original reference number and if they have said they cannot get the billing data you will take this further again. If you have the billing data advise it does not correspond to the charging regulations and you request a Bill Recalculation done and the charges fully investigated by BOTH the UK network provider and foreign network provider. I know for a fact we had a department dedicated to doing this.

If they return and advise the charges are correct and you still don’t have the billing information request this once again and advise you will be going to Ofcom to request this. If you have both and they still don’t budge raise this with Ofcom and supply full information. If you had a roaming bar applied then request to see the screen shot as all NETWORK CAMMANDS are trackable and if they say it failed to go on they are liable and if it went on and they send you the proof screen shot why have you got these charges? Unfortunately neither the networks or mobile manufacturer’s seem to want to take this issue seriously so it needs to be power to the people

I think there is a definite problem here. Having spoken to Apple they say that you cannot receieve data if the data roaming feature is off. End of. However if there is a software problem, it could be their fault. I suggested that but they didn't want to hear that. But they said they would investigate...mmmm think there is little chance of that.


As for o2...man I am so tired of them - but i know this is their gameplan - wear me down...but it will not work..... I spent an hour or so yesterday on the webchat with them (this is following a heated conversation the day before where they basically accused me in very polite words of being a liar and stupid and refused to budge). On the webchat the person agreed to refund the £30 data charge I had and investigate the problem. Today i got an email where they reversed that promise. I have a transcript of the convo from yesterday.


However one thing that is common to all of their advisors and the training they have had is that they will tell you tht you are subject to data charges even if you use wifi abroad....come on....really....? my data roaming is off and i use free hotel, or free restaurant wifi, i shoudl not be charged by anyone....!!!


I am going to fight this and fight it.

Hi Guys


Just to let you know, same thing happened here with me. Turned off 3G and Data Roaming before leaving UK. Whilst in Egypt, Only used local free wifi hotspots. However, after using and walking away from one hot spot location, got a text message from o2 stating that I've reached my £40 data cap limit. A little bit shocked and confused, I waited to get back to the UK before questioning it. They also gave the same crap about User error, blah blah blah. Weird thing is, I also use a Galaxy S2 and Note, and no such problem with either of them!


Spoke to o2 who were going to open an investigation, blaming User error, but was also speaking to a Web Support person, who in the end I asked for my PAC code because of what happened! They in turn then passed me onto the Concern Team, who've offered to reimburse the £40 roaming charges that were incurred. I also queried the fact, that if you turn off both 3g and data and use the Wifi option, why would it turn on data! They advised to delete or edit your APN confiuration settings (Which seems to be a little bit daft)


If your in a position to end your contract, this would make them sit up and smell the coffee! Hope your succesfull in your claim!

I have the same issue ! called apple and they said it is not possible ..and so they say not their fault.

I will try to resimulate the issue in Belgium without data roaming but only with localdata use in other words disable mobile network for a wile - set the counters on zero and only work with wifi.

If then the counters move up it is a proven io bug i can show and thuss make my case stronger ..

any other users having the issue ????
