The answers to both of your questions are: yes, if the company chooses to do so.
However it is not the issue in this case, it is about the network tab in task manager display an incorrect link speed (in our case 1 Mbps).
You can find out your actual transfer speed using a speed testing site like speedtest.net or any other as it was recommended in the previous post.
If anyone finds an article about the actual link speed for the iPhone USB tethering, or on changing the displayed value in the Windows 7 task manager, please post it.
