The pen was not in the box with new IPad 6th generation

I'm curious what led you to believe it would be included in the box with your iPad? Apple has never bundled the Apple Pencil with any of the iPads. It's always been an add-on accessory you could buy or not buy depending on your need.

See that pencil under the giant iPad pic? Most people don't read the tiny footnote:

1. Apple Pencil and keyboards are sold separately.

If that picture includes a keyboard, people would expect to see a keyboard and a pencil in the box.

At least in the USA, technically no. Given the plethora of state and federal laws that govern honesty in advertising, the image of an item does not at all promise what is included, small print or not. e.g. Cars shown in ads show max feature options offered, despite a MSRP shown based on minimal options, products are shown in settings with accessories that are optional and cost extra - these are all legal ads in the USA.

The bottom line, again in the USA, is it is on the consumer to investigate and understand what is actually being purchased when they make a purchase.

It does not come packaged with the iPad. It is a separate purchase.
