Apple TV remote not pairing

My apple TV remote had been working fine, now it will not pair. I get the message saying to bring the remote closer to the ATV to pair, then after a few seconds it says 'remote connected' but as soon as I press a button, it just repeats that I need to bring the remote closer to pair. I just charged the remote overnight, no change.

The closest possible position that should work to complete the pairing, is laying the remote on top of the Apple TV.
